Important dispute notice: Section 18 provides for binding individual arbitration of covered website disputes, with limited exceptions and a 30-day opportunity to opt out. For disputes subject to arbitration, you and RESG Inc give up a court trial and participation in a class proceeding as described there. Please read that section before agreeing.
1. Operator, scope and agreement
RESG Inc operates AskAnton.com. In these Terms, “AskAnton,” “we,” “us” and “our” mean RESG Inc in its role as website operator. These Terms cover AskAnton.com and the related inquiry, chat, appointment and communication features that link to them, together called the “Services.” Anton Stetner and RESG provide licensed real estate brokerage services through NWRE LLC, a separate entity from the website operator.
By using a feature after being presented with notice of these Terms and taking the action identified as agreement, you agree to these Terms. If you do not agree, do not submit information or use that feature. Our Privacy Policy explains how we handle personal information. Agreement to these Terms does not replace a separate consent or disclosure required for a particular activity.
These are general website terms. A separate brokerage, purchase, sale, loan, referral or other service agreement controls its own subject matter if it conflicts with these Terms. These Terms do not establish a commission rate, obligate you to hire a provider or commit you to a transaction.
2. Eligibility and authority
Our inquiry and appointment services are intended for adults. You must be at least 18 and legally able to enter this agreement to submit an inquiry or use those services. If acting for another person or business, you must have authority to do so and to provide the information and permissions involved. Do not impersonate anyone or misrepresent your authority.
3. Services and commercial purposes
AskAnton provides real estate information, automated conversations, inquiry handling, appointment requests and introductions to people and businesses. Our purposes include generating leads, converting inquiries into business, following up with prospects, marketing services, producing content and improving our workflows and knowledge.
Available features may include property information, calculators, estimates, investment or development information, cash-offer inquiries and financing introductions. A feature's presence does not guarantee a loan, offer, appointment, representation, transaction or other result. We do not promise a response within a particular time. Do not use the Services for emergencies, contractual notices requiring another delivery method or time-critical transaction instructions.
4. Submissions and sensitive information
“Your material” includes questions, messages, property information, photographs, documents and other content you submit, and your contributions to related communications. Provide information that is accurate to the best of your knowledge. You retain ownership of material you own. Submit material only when you have the rights and authority needed for the uses described here.
Do not put passwords, Social Security numbers, payment details, bank credentials, medical records or unnecessary sensitive information into ordinary chat or uploads. Remove unrelated personal details from property documents where practical. Do not submit another person's confidential material without authority. Public availability does not necessarily mean that you own a photograph, listing or document.
You may ask about fair housing, accessibility or reasonable accommodation. Describe the need without unnecessary medical details and contact us if a more suitable channel is needed. These submission rules do not restrict those rights.
Contact info@askanton.com promptly about an accidental sensitive submission. Our goal is to restrict, remove or redact inappropriate information when identified, but we cannot guarantee detection of every detail or immediate deletion from all connected systems. Applicable privacy obligations, required records and legal holds still apply.
5. Permission for service, AI and internal knowledge uses
You grant RESG Inc a nonexclusive, worldwide, royalty-free license to receive, store, copy, transmit, summarize, analyze and adapt your material as reasonably needed to provide and secure the Services, respond to you, coordinate requested services, support lawful marketing and operate the uses described in our Privacy Policy. We may allow staff and providers acting for us to perform those activities within that scope.
These uses include AI-assisted responses, property research, follow-up, quality review, workflow improvement, organizational memory and knowledge development for better service, lead generation, lead conversion and content creation. We may enrich inquiry information with public records, property sources and commercial data where we have the necessary rights and lawful basis.
We use existing AI models for these activities; this is not permission for an AskAnton project to train or fine-tune a model on visitor records. A provider's handling of information depends on the particular service, account and settings, as explained in the Privacy Policy. This license does not waive privacy rights, override communication choices or authorize every provider to use material for unrelated purposes.
6. Upfront permission to create and publish content
Submissions can become content. When you submit your material under these Terms after receiving the submission notice, you authorize RESG Inc to select, edit, adapt, reproduce, publish and distribute that material in educational, informational and promotional content about real estate and our services. This nonexclusive, worldwide, royalty-free permission covers our website, newsletter, articles, social posts, videos, presentations and related marketing, including production and distribution through providers acting for us. No payment is due for uses within this permission.
Covered material can include your questions, experiences, stories, quotations, submitted images or documents, and conversation excerpts or complete conversations selected for publication. Permission also covers your own name, image or other identifying details contained in material you are authorized to submit, within the stated content uses and to the extent that consent is valid under applicable law. We do not seek a new permission for each use already covered by a valid authorization.
This permission applies to the inquiry and related follow-up for which the notice was provided. It does not automatically cover unrelated future submissions, another person's rights, confidential transaction records, sensitive records or material you lack authority to license. Required confidentiality, privacy and brokerage obligations take precedence. A private call or video recording requires its own recording notice and permission; public use of its audio, video or transcript must also fall within an applicable content authorization. These Terms do not authorize voice cloning, a fabricated endorsement or presenting invented statements as your words.
We review material selected for public use and aim to remove unnecessary personal details where a piece is intended to be de-identified. We cannot guarantee that every identifier will be removed or that a person or property cannot be recognized. That limitation does not authorize unlawful disclosure. Public material may be copied by others and may remain available outside our control.
You may contact info@askanton.com to withdraw permission for future public content uses or raise a concern about an existing use. We will stop new public uses after processing the request and review existing uses under applicable rights and circumstances. Withdrawal does not necessarily require recalling material already lawfully distributed, and we cannot guarantee removal of third-party copies. Applicable legal rights remain available. Retention of selected source material and ordinary raw records follows the separate schedules in our Privacy Policy; this license does not make every raw record permanent.
7. AI answers and professional advice
The website assistant is automated. Chat messages are recorded and may be reviewed by authorized staff and processed by service providers. AI answers may be wrong, incomplete, biased or out of date. A human may not have reviewed an answer before you receive it. AI can produce unexpected errors that have not yet been identified.
General website content and automated output are for informational, educational and entertainment purposes. They are not a substitute for advice from the appropriate licensed professional about your circumstances. Verify important property facts, financial figures, deadlines, legal requirements and transaction terms before acting. We do not guarantee that an answer or follow-up message is correct or suitable for your situation.
General information is not a loan approval, appraisal, inspection, survey, legal opinion, tax advice or investment recommendation. Nothing in these general Services offers a security or commits a person to invest or provide capital. Actual professional services and any separately documented offering must be evaluated under the laws and agreements that apply to them. Calling content educational or entertaining does not remove duties attached to an actual professional service.
8. Brokerage relationships and property transactions
Browsing a page or sending a general inquiry is not a signed brokerage services agreement. Brokerage services involving Anton Stetner and RESG are provided through NWRE LLC. Agency relationships and duties depend on applicable law and the services actually performed, together with applicable agreements and disclosures. These Terms do not postpone, eliminate or replace those duties.
Property information, market data and descriptions may come from owners, public records and other sources. Availability, prices, condition and other facts can change or be inaccurate. Any listing content remains subject to the source's rights and applicable restrictions; the website does not promise that an MLS or live listing feed is available.
Calculator results and automated estimates are illustrations based on inputs and assumptions. They do not constitute a formal appraisal, guaranteed sale price, guaranteed return, loan commitment or promised proceeds. A separately commissioned professional report is governed by its own scope and terms.
A cash-offer inquiry, preliminary price range or automated response is not a binding purchase offer or commitment to close. The actual buyer may be an affiliated or independent party and will be identified in the relevant offer documents. Any binding commitment depends on authorized transaction documents and their conditions, which may include title, property, financing and other review.
9. Referrals, compensation and affiliated businesses
We may introduce you to real estate professionals, lenders, builders, developers, contractors, title and escrow providers, buyers, investors and other relevant service providers. Each provider's services are governed by its own terms and applicable duties. An introduction does not guarantee acceptance, funding, performance or a result, and does not eliminate our responsibilities for our own conduct.
Anton Stetner, RESG, RESG Inc, NWRE LLC and/or other involved businesses may receive real estate commissions or other lawful compensation. Referral and affiliated-business relationships may provide a financial benefit. Not every introduction is paid, and these Terms do not authorize prohibited referral payments.
RESG Inc has an ownership interest in RESG Homes LLC, which provides new construction and land development services, and Northwest Escrow LLC, which provides title and escrow services. RESG Inc may benefit financially when those businesses provide services. These entities are distinct from RESG Inc and NWRE LLC.
You are not required by these Terms to use an affiliated provider. Relevant brokerage, referral, affiliated-business and transaction disclosures will address the particular relationship and service. This general notice does not replace a disclosure required at a specific referral or transaction.
10. Communications, subscriptions and recording
When you provide contact details and request assistance, we may use those details to respond, coordinate appointments and follow up about your request, subject to applicable law and your choices. Our Privacy Policy explains marketing and affiliate sharing. These Terms do not enroll you in every communication channel or cancel a previous opt-out.
When you affirmatively select newsletter signup, we may enroll you in the AskAnton newsletter through Beehiiv and send messages within that subscription without asking again for each message. You can unsubscribe using the message link. Newsletter signup is optional and is not preselected during an inquiry.
Where marketing texts or calls need additional consent, the relevant notice will identify the sender and communication type and obtain that consent. Any enabled recurring messaging program must disclose its applicable frequency, charges and support/opt-out methods. Follow the program's instructions, including STOP where supported, or contact info@askanton.com. Required consent is not supplied merely by a newsletter subscription or content license. Where required, marketing consent is not a condition of purchase.
Phone and video appointments may be recorded and transcribed after required notice and consent. Tell us if you do not wish to be recorded so that an appropriate alternative can be arranged. Agreement to these general Terms alone does not establish every required recording or public-use permission.
11. Privacy, cookies and records
The Privacy Policy explains collection, enrichment, sharing, AI processing, analytics, advertising, choices and retention. Cookie and privacy controls provide applicable choices for enabled technologies. Content permission does not replace those controls.
Ordinary raw chats and recordings have limited retention schedules. Relevant communications that become transaction records follow applicable brokerage and transaction-file requirements. Selected authorized content sources, consent records, opt-out records and legal holds may follow different schedules. Contact info@askanton.com about access, correction, deletion or another applicable privacy request.
12. Fair housing and accessibility
We support fair housing and equal opportunity in advertising, information, referrals and services. Do not use the Services to discriminate unlawfully or request unlawful steering or exclusions. Report a fair housing concern, accessibility barrier or request for accommodation to info@askanton.com. An automated answer does not override applicable rights or our responsibilities.
13. Acceptable use
Use the Services lawfully. Do not commit fraud, impersonate people, harass or threaten others, upload malware, access private records without authorization, interfere with operation, bypass security or knowingly violate intellectual property, privacy, fair housing or other rights. Do not harvest personal information or copy restricted materials for unauthorized use. Restrictions on copying, analysis or reverse engineering apply only to the extent permitted by law.
These rules do not prevent truthful criticism, lawful reviews, protected reporting or exercising a legal right. We may restrict access or remove material when reasonably needed for security, legal compliance or preventing misuse.
14. Website materials, feedback and third parties
Website designs, text, software, images and branding belong to RESG Inc or their respective owners and licensors, to the extent protected by law. You may access and use them for personal or internal business purposes consistent with these Terms. Other uses require appropriate permission unless allowed by law. Do not imply our endorsement or misuse another party's marks.
You allow us to use voluntary suggestions about improving the Services without payment. This feedback permission does not expand the separate permissions for your personal information or submitted material.
Third-party links and services may have their own terms and privacy practices. We do not control or guarantee their performance. Our use of a provider does not remove duties that apply to our selection, instructions or handling of information.
15. Beta availability
The beta is publicly accessible, even when invitations are limited to a small group. Features may be incomplete, inaccurate, unavailable or changed without notice. Nothing is guaranteed to work as expected. Use beta features at your own risk to the extent permitted by law. Beta status does not remove privacy, consumer or brokerage obligations.
16. Warranties and service limitations
AskAnton.com, its website features, AI responses, property information, estimates, calculators, downloadable materials and general follow-up content are supplied “as is,” with any faults, and “as available.” To the fullest extent permitted by applicable law, RESG Inc, Anton Stetner, NWRE LLC, participating affiliated businesses and the providers acting for them make no representations, warranties or guarantees concerning those website Services or their content, whether express, implied or statutory. This disclaimer includes accuracy, completeness, timeliness, reliability, suitability, merchantability, fitness for a particular purpose, title and noninfringement.
We do not promise that the website, AI or connected tools will work without interruption, delay, error, harmful code or security failures; that a message will be delivered or received; that a defect will be corrected; or that content will remain current. Website use and reliance on general content are at your own risk, subject to the rights preserved below.
We do not guarantee a property value, savings, investment return, loan, offer, referral, appointment, response time or transaction outcome. General answers and marketing communications do not create additional warranties merely because they are provided orally, in writing or through AI. Third-party information and links do not constitute a guarantee of that party's services or performance.
These provisions apply to general website Services and content, not to the elimination of duties under a separate professional or transaction agreement. They do not excuse fraud or eliminate any representation, warranty, professional duty, right or remedy that applicable law does not allow us to disclaim.
17. Limitations of liability
To the extent permitted by law, RESG Inc and people acting on its behalf in operating the general website Services will not be liable for indirect, incidental, special or consequential damages arising from those Services. This includes lost profits, lost opportunities or lost data only where they are indirect or consequential damages, rather than direct losses.
This exclusion does not apply to fraud, willful misconduct, gross negligence, breach of an applicable duty of confidentiality, or any liability or remedy that cannot lawfully be limited. It does not limit rights or remedies under applicable consumer, privacy, fair housing or brokerage law, or obligations under a separate professional or transaction agreement.
These Terms do not impose a fixed dollar cap on direct damages. Whether any exclusion applies depends on the claim and applicable law.
18. Washington law, arbitration and court venue
Applicable law and covered disputes
Washington substantive law governs these Terms, subject to protections that applicable law requires us to preserve. The Federal Arbitration Act governs this arbitration agreement where it applies; otherwise applicable Washington arbitration law governs.
Except for the exceptions below, you and RESG Inc agree to resolve disputes between us arising from these Terms or use of the general website Services through binding arbitration. This provision concerns website use, including associated content and data-handling claims. It does not amend a separate brokerage, mortgage, employment or transaction agreement, compel arbitration where prohibited by law, or bind a nonparty merely because we mention or refer that party.
Informal resolution
Before filing an arbitration demand, send a notice explaining the dispute, requested resolution and a way to contact you to info@askanton.com, or to RESG Inc at the address in Section 20. We will send our notice to contact information you provided. Both sides will make a reasonable effort to resolve the matter for 30 days after receipt. Either side may file sooner to preserve a legal deadline or obtain available urgent relief; no personal conference is a condition of a claim. This process does not restrict a regulator complaint or small-claims filing.
Administrator, process and costs
The American Arbitration Association (AAA) will administer the case before one neutral arbitrator. Consumer cases use the AAA Consumer Arbitration Rules and Consumer Due Process Protocol; nonconsumer business cases use the applicable AAA Commercial Arbitration Rules. Current rules and filing instructions are available at adr.org. To begin, file a demand with AAA and provide a copy to the other party under the applicable rules.
For a consumer case, RESG Inc will pay the fees and arbitrator compensation allocated to the business by the applicable AAA consumer schedule. A consumer pays no more than the applicable capped consumer filing fee, subject to available waivers and any further allocation required by law. Nonconsumer costs follow the applicable rules. Each party bears its own legal fees unless applicable law authorizes an award. These Terms do not create a visitor indemnity, a general loser-pays obligation or a duty to fund our defense.
The arbitrator may award remedies available for the individual claim under applicable law, including statutory damages, legal fees or injunctive relief where authorized, subject only to lawful limitations. The award will be written, explain the essential reasons, and may be entered in a court with jurisdiction. Court review is limited under applicable arbitration law. A court decides disputes over formation or enforceability of this arbitration agreement and the class-proceeding restriction; the arbitrator decides other matters assigned by applicable law and the rules.
Snohomish County and remote participation
The designated arbitration location is Snohomish County, Washington, subject to applicable law and AAA's consumer accessibility and location requirements. Remote or documents-only proceedings may be used as the rules permit. A consumer is not required to travel to Snohomish County if doing so conflicts with those requirements; AAA or the arbitrator may set another reasonably convenient location when required. The parties may agree to another location after a dispute arises.
Individual proceedings and exceptions
For claims covered by this arbitration agreement, both parties waive a court or jury trial and agree to proceed individually, without class or representative arbitration. Claims may not be combined with another person's claims without all affected parties' agreement. This restriction does not eliminate relief that applicable law makes nonwaivable. If the restriction cannot be enforced for a particular claim or remedy, that claim or remedy proceeds in a competent court; it does not authorize class arbitration without the parties' agreement.
Either party may bring a qualifying individual claim in small-claims court. Either may seek available temporary court relief while arbitration is arranged. You remain free to report concerns to government agencies and exercise rights that cannot be subjected to arbitration. If AAA declines administration because we fail to meet its requirements or pay required fees, you may proceed in a competent court. If AAA is otherwise unavailable, the parties may agree on a substitute; absent agreement, either may proceed in court.
Thirty-day opt-out
You may opt out of this entire arbitration agreement, including its class-proceeding restriction, by emailing info@askanton.com or mailing RESG Inc at the address in Section 20 within 30 days after first agreeing to it. State that you opt out of arbitration, provide your name and the contact information used with AskAnton, and identify the approximate date you agreed. Do not send sensitive identification documents. Timely sending or postmark is sufficient. Opting out does not affect access to the website or the other Terms, and neither party will be bound to arbitrate under this section.
Courts and subsequent changes
For disputes permitted to proceed in court, including arbitration enforcement proceedings, the parties agree to exclusive venue in the state courts in Snohomish County, Washington. Where federal subject-matter jurisdiction exists, the designated federal forum is the United States District Court for the Western District of Washington, Seattle Division, subject to that court's assignment rules. These venue provisions yield to mandatory rights to another forum, applicable small-claims procedures and any legally required location for enforcement against a party or assets.
Material amendments to this arbitration provision require notice and renewed agreement before applying to you. They do not change the handling of an already asserted dispute without both parties' agreement. A renewed agreement carries the same 30-day opt-out opportunity. A contact-address correction alone does not create a new agreement or erase an earlier opt-out.
19. Updates, ending use and general provisions
We may change the Services and update these Terms. We will post the updated Terms with their effective date and give reasonable additional notice of material changes. Where required, we will obtain new agreement or permission. We do not apply a new content license retroactively to previously submitted material without the necessary authorization.
You may stop using the Services. We may suspend a feature or restrict access for reasonable operational, security or legal reasons. Ending use does not erase obligations already incurred, applicable recordkeeping, lawful prior publication or rights and remedies that survive by their nature. Content permission remains subject to Section 6 and applicable privacy rights.
If a provision is unenforceable, the rest remains effective to the extent permitted by law. Not enforcing a provision once does not waive it later. These Terms and expressly applicable service terms describe the agreement for general website use; the Privacy Policy explains data handling. Separate professional and transaction agreements retain their own scope. A lawful business transfer does not expand content permissions or remove applicable privacy obligations. No provision limits a right or remedy that cannot lawfully be waived.
